Terms and Conditions (Terms of Service)

These Terms and Conditions (“Agreement”) govern the rules for using the AI-powered SEO and content generation services (“Services”) provided by Haysoft (“We”, “Us”, or “Platform”). By registering for our Platform or using our Services, you acknowledge that you have fully read, understood, and agreed to be legally bound by this Agreement.

1. Description of Service

Haysoft is a cloud-based Software as a Service (SaaS) platform that allows users to conduct SEO analysis for their websites, process sitemap data, and generate Artificial Intelligence (AI) powered text content. We reserve the right to update, modify, or remove certain features of the Services at any time without prior notice.

2. Account Creation and Security

• You must be at least 18 years old to use the Platform.

• You are responsible for ensuring that the information you provide during registration is accurate and up-to-date.

• You are entirely responsible for maintaining the confidentiality and security of your account password. Haysoft cannot be held liable for any damages or losses arising from the unauthorized use of your account. Account sharing (the use of a single account by multiple individuals or companies) is strictly prohibited and may result in account termination.

3. Subscriptions, Payments, and Renewals

• Our Services are offered on monthly or annual subscription models.

• Unless otherwise stated, our prices are shown exclusive of applicable taxes (e.g., VAT).

• Automatic Renewal: At the end of your selected billing cycle (monthly or annual), your current plan will automatically renew, and your registered payment method will be charged unless you cancel your subscription beforehand.

• Cancellations, refunds, and plan changes are subject to the “Refund and Cancellation Policy” available on our Site.

4. Acceptable Use and Prohibited Activities

You agree to use the Platform only for lawful purposes. The following actions are strictly prohibited:

• Organizing cyber attacks (DDoS, SQL Injection, etc.) aimed at disrupting the Platform’s infrastructure, or attempting to reverse engineer the software.

• Using our AI engines to generate illegal, hateful, copyright-infringing, or explicit content.

• Overloading Haysoft systems and exploiting API limits via automated bots, software, or scripts (“Scraping”). In the event of a violation of these rules, Haysoft reserves the right to immediately suspend or terminate your account without prior notice and without issuing a refund.

5. Intellectual Property and Content Ownership

• Haysoft’s Rights: The design, code, algorithms, logos, and trademark rights of the Platform belong exclusively to Haysoft. They may not be copied or used without permission.

• Your Rights: The copyright and ownership of all blog posts, SEO analysis outputs, and text content you generate using the Haysoft platform belong entirely to you. You are free to publish or use this content commercially anywhere you wish.

6. Disclaimer of Warranties and Limitation of Liability (IMPORTANT)

• AI Accuracy: Our Services are powered by artificial intelligence models. By nature, AI may occasionally produce incomplete, illogical, or inaccurate information (known as “hallucinations”). It is strictly the user’s responsibility to verify the accuracy and legal/ethical compliance of the generated content before publishing.

• No SEO Guarantee: Haysoft aims to provide you with the best SEO strategies. However, the algorithms of Google and other search engines operate independently. Haysoft does not guarantee that your website will reach a specific ranking, or experience an increase in traffic or revenue.

• In the event of a legal dispute, Haysoft’s maximum financial liability is strictly limited to the total subscription fees paid by the user to the platform in the preceding 12 months.

7. Termination

Haysoft may, at its sole discretion, suspend or terminate your account if it determines that you have violated these Terms and Conditions. You may also stop using the Platform at any time by canceling your subscription.

8. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany (BGB). Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Your German City, e.g., Berlin], Germany.
